It's a weird story, but it looks like Engage In-Game Advertising's is in some hot water with Valve. The company was serving Subway ads in matches of Counter-strike. Valve's Doug Lombardi says the company is considering legal action.
Who the hell is Engage and how did they insert ads into CS without Valve knowing about it.. Sorry if I being daft here but it seems it would be difficult to do it without valves ok...Isn't CS run off of Steam?

It can easily be done with re-working of textures areas on maps. Even with Steam, if they're running the servers, they can insert advertisements.
That's insane. If Valve wants to control what happens on game servers, then they should host them. If they're not willing to do that, then leave'em alone. If I host a server, then I control it. All of it.
I don't want any company deciding which textures, maps, mods, or models individuals can run on their own server.

Steam and HL are trademarks of Valve Software. If another franchise is using their products to make money or using them to sell space to other third-parties. Thats a direct violation of their trademark and copyrights, especially if Valve didn't sanction them or was not asked permission. Valve has every right to take legal action whether they purchased the game or ran their own servers.
Fuck 'em. I don't care about the legality, I don't want ads in games.

I know that some publishers are putting ads in games. I have NFSMW which I believe has ads... I'm honestly driving too fast and watching the road to notice/read them. Maybe they are going for subliminal advertising in that game.
Note to David Smith - breaking the law by using and abusing someone else's intellectual property and then telling the world you're doing it will land you in legal hot water quicker than Donald Trump can say "you're fired". What a fucking joke.

They made the game, they own the game. I don't bother reading the EULA but I'm pretty sure it stipulates: "If you try to make money off our game without giving us a piece of the action, get ready to get WTFPWND."
Getting the ads into the game could be nothing more than an invasive script that I've seen from time to time that a server uses to host custom options while the game is playing. Granted, I haven't played CS: Source or DoD because it reminds me of how I need to upgrade.
You want to modify a game in some way for non-commercial use? Perfectly legal (despite what Team Ninja would have you believe).
You want to modify a game for commercial use? Better get permission. This would be about the same as if General Mills hadn't gotten permission from ID software to make Chex Quest on the DOOM engine. It's advertising using a game engine, and that costs licensing fees.
