Pretty sure I've heard the 'memory in the DNA' idea well before Assassin's Creed. I wouldn't quite call it original to begin with. Also, the brief I read on this novel, Link, claims it's the soul. It's far more new age BS than scifi.
In any case, I'm pretty sure the judge will laugh at the idea of halting the release of AC3. One unsuccessful author is not going to force an international publisher to lose one of their best sources of revenue, quite possibly bankrupting the company, simply because they both used a similar trope.
Lets be honest, if it's true, it wouldnt be the first time somebody has ripped off someone elses work precisely because it was obscure and unknown. ( Two current singers spring to mind immediately).
I'm pretty sure there is a level of copying that becomes plagiarism and is actionable. Don't know what the right term is, but I've seen movie studios sued successfully after they reject a script then magically come out with a very similar movie a few years later.

Ask the Wachowski brothers and the Matrix movie studio about that. They lost big time in that exact scenerio.
