ZeniMax and Mojang Settle "Scrolls" Trademark Lawsuit


ZeniMax Media sends along a press release annoucing that a settlement has been reached in the lawsuit with Mojang over the "Scrolls" trademark.

March 12, 2012 (Rockville, MD) – ZeniMax® Media Inc. today announced that a settlement has been reached in the lawsuit it filed over Mojang’s applications for ownership of the ‘Scrolls’ trademark. The lawsuit was filed by ZeniMax when Mojang submitted applications covering a range of ‘Scrolls’ trademarks for use in video games and other media. In its complaint, ZeniMax cited a conflict with its longstanding trademark for ‘The Elder Scrolls’, the name of its highly-successful video game franchise published by ZeniMax Media’s publishing arm, Bethesda® Softworks.

Under the terms of the settlement, all ownership rights to the ‘Scrolls’ trademark will transfer to ZeniMax, and Mojang will assign to ZeniMax ownership of any pending “Scrolls’ trademark applications. ZeniMax has licensed the ‘Scrolls’ mark to Mojang to be used solely in conjunction with its existing Scrolls digital card game and any add-on material it makes to that game. The terms of the settlement bar Mojang from using the Scrolls mark for any sequel to the current card game, or any other video game.

"We are pleased to have settled this matter with Mojang amicably,” said Robert Altman, Chairman and CEO of ZeniMax. “The Elder Scrolls is an important brand to us, and with this settlement we were able to protect our valuable property rights while allowing Mojang to release their digital card game under the name they preferred.”

Because if I name my racing game "Cars" I'm going to get the crap sued out of me by pixar, disney, and possibly jay leno.

Zenimax, you suck. You do NOT own the English language. Having a trademark on the term "The Elder Scrolls" should in no way entitle you to restrict someone else from naming their product (even if it's a competing product) "Scrolls".

I am seriously sick of and disgusted by the stupidity that occurs in our patent, copyright, and trademark system. I don't typically resort to profanity, and I'm still not going to here. But really, Zenimax--eff you guys. Eff you guys in the A all the way to the back of your litigious throats.

If you named your game "All my Cars are Blue" they shouldn't have any right to make you change the name of your game. It's bullshit that they get to enforce every word in a title. It's not like they named their game "Adventures with Diablo, The Lord of Terror" or even "The Very Old Scrolls".
If I name my game "The", then hell, I'd better watch the )(*@#$&! out.

You shouldn't be able to copyright a word, only a unique phrase :\ This ruling is stupid. It's not like Mojang tried to name their game "The Edler Scrolls" -- that might be suable, but technically wouldn't that count as a parody!

There was no ruling, there was a settlement. Both parties agreed to this as opposed to going to court over it and paying those legal costs. The court system is not at fault here, the legal system which allowed Zenimax to outflex Mojang is.
