The NES clone, Generation NEX has been released and Vintage Computing and Gaming (http://www.vintagecomputing.com/index.php/archives/6) had some not-very-nice-things to say about it.
With all its problems, it would have more appropriately been named the Generation SUX.
It's a shame, I had hoped this would turn out good. Oh well, guess the Revolution's "Virtual Console" is looking pretty good about now.

I don't get the appeal of these NES clones. Pretty much *any* PC made in the last 8 years can play a NES emulator at full speed. Want the real NES experience? Get a TV-Out cable and connect it to your TV and then get a SNES-TO-PC controller adapter or something. Or play NES games on the Go on your PSP or DS. Or...
Personally, I use a 4-year old computer that I've set up next to my current-gen home consoles and TV just for playing emulated games. Works fine for me but whatever.

I understand that this thing is garabage, but he complains about the controllers buttons feeling 'mushy'. Weren't the buttons made to have a 'mushy' feel? Or was it only the 5 or so that I bought?

I would like to take this moment to encourage everyone who wants an old NES to consider buying mine for $100 (includes some games and is in mint condition) or to do what I did to GET mine -- go on eBay and spend $40. You'll get a like-new NES with 10-20 games and two controllers.
Gee whiz... can it be that easy?

There is a big difference between warezing a new PC game that actually hurts the developement team and downloading a few NES games instead of spending tremendous sums of money buying 15 year old games at inflated prices from collection whores on eBay. The fact that that you're drawing ridiculous comparisons like this just shows that you guys are either completely nuts or just have too much money on your hands, or both.

I have ebayed a thrift shopped most of my childhood favs after year and tech stuff other wise for whatever experiance I want.

A NES console pre modded with all games should be a perfect simple perfect experiance (with a Fast Forward Button)
Truly a shame for those who dont have the originals, there experiance will be unfairly skewed by this product that is no doubt lacking the

emulating 20 year old nintendo games is very different from downloading a brand new pc game. there is absolutely nothing wrong with emulation of games you have no chance in hell of getting ahold of other wise.

Is this NEX shit legal? Does Nintendo get any of the profits, or is it like those mall kiosk warez boxes? I do not mind emulating software, but selling emulated software is pretty fucked up.

They're not selling anything with software on it. What they're doing is re-engineering the hardware, which is legal. It's the same legal loophole that was used to make "PC compatible" rom-bios back in the day.

A $10 replacement connector will fix about 90-95% of the dead or half-functioning NES systems out there.
I've fixed four NES systems the same way. They now work better than they did when they were still current systems (no more fussing with getting games to start)
Top-loading redesigns or 3rd party clones aren't necessary. All you need is a new connector and a screwdriver.

it's still stealing no matter how you try to justify it. nintendo still has plans for them, even if they are retarded, so you're hurting nintendo by downloading their games. if a company really wanted to support abandonware they would give it away for free. and sometimes they do to promote newer games etc.
and on the nex, how stupid do you have to be to make a console with a crappy controller in this day and age? it's just downright negligent.

But what happens when these games are once again available to purchase through the Revolution's online catalog? Technically the games they have listed are no longer abandonware - the ROM will once again be illegal.

Er, actually I think Nintendo probably does. I agree with you in theory, but Nintendo *is* likely going to be making many of these games available again, including, I'm sure, the original Duck Hunt.

But, then I can't blow in my cartridges and fiddle with the power button for a minute to get the game to start. Where's the nostalgia? I dunno, I'm happy with just any normal NES off eBay, they still all work great (or only need the connector swapped out for a new one, maybe replace a capacitor, etc).

Well, they're really not. I filled out my NES collection for $5-15 a game, far cheaper than they were bought new. Unless you really need to have a mint condition game in it's original packaging with manual and what have you.

Fleamarkets are prime for NES and SNES games. I snagged Mario RPG for a dollar. That was a happy day.

Software copyright lasts, I believe, last for 75 years and is automatically granted (with some variation from country to country, but this is more than likely how it is in your country). So unless the holder of the copyright offers the game for free (eg Grand Theft Auto) copying a videogame is illeagal.
As for "abandonware", this is a set of guidelines for ethical piracy and not law or policy of many (if any) publisher.
Did you complain when "Star Wars" was released on DVD because it is 20 years old and so should be free? What about books? They have even older copyrights still in tact. Music?
And since any game from Nintendo's previous consoles will be able to be added to the "Virtual Console" downloadable list (not to say that all will), these games may soon be on the market again. Also what about the "NES Classics" line on the GBA? Or SNES ports?
What about "Sonic Gems Collection"? Or "Retro Atari classics"?
I'm not saying it's right for them to do it. But it is their right to do it if they want.
Think of it this way: "If it was my intellectual property, what would I do?"

Books go to the life of the author plus 20 years, I believe. Lots of old stuff can be found pretty easily online now, and soon to be easier yet with Google's library project.

It is. They lost their patent on the old NES hardware.
That's why it isn't illegal.
If you no longer hold a patent for something, it technically isn't yours anymore.
As I mentioned in another NEX thread, I actually have one and it works as well as I could have hoped. The controller's fine, as is the hardware. Every single cart I own works just as well as it did on the original hardware.
It's more than I could have asked for, really.
There is no legal doctrine of abandonware.
You don't have the right to copy a work just because the copyright holder does not currently market a product.
Distributing ROMs of games not currently available is illegal.
