El Reg is reporting (http://www.channelregister.co.uk/2005/08/08/sony_sues_lik-sang/) on the continuing legal battle between world famous online import shop Lik Sang and Sony.
Lik-Sang vowed to fight the case, claiming it has Hong Kong trade regulations on its side. They, it said, "allows free trade once an item entered the market for sale". In other words, what we do with a PSP once we've bought it is up to us - and that includes selling it on to consumers in the UK and elsewhere.
Wait.. did I miss the whole point of globalization?

So, if I've got this straight, Sony could, theoretically mind you, pound the living snot out of me if I sell my PSP, PS2, etc. ad nauseum on eBay to one of our gaming brethren from foreign shores?
Might they more realistically pound on an eBay for facilitating such sales? Are they just trying to make folks dislike them? Dammit, that's Microsoft and Electronic Arts' side of the street!

if you use their trademarked logos on your page without their permission, yes. Seems pretty simple.

Maybe Lik Sang should advertise PSPs as "second hand"? Would that work?

This is enough to force me to not buy a PS3, I don't care what the fuck they have out for it. They could have "Game Made for Perigon" out as a launch title and I still won't buy the damn thing. When a company starts fucking with free-trade, I stop buying.

But with Revolution, buying it will let you download all the previous incarnations of Game Made for Perigon released on Nintendo systems for a mere 30 dollars more each.

If it is, it gives more legitimacy to the reports of people getting hassled by Sony in the UK about selling/importing PSPs. Unfortunately the average consumer neither knows of this, or cares about its implications.
They just want a pretty, functional handheld. Wait, that is what I want! But, I don't want one w/a track record for defects.

You're forgetting a key point. Sony didn't tell all of those ebay people to stop using the logos, nor are they people that have previously been beatdown by Sony in a lawsuit.

Actually... I am not sure about the law in other countries, but in the US, I think, that you can't choose who to tell not to use your logo and who not to. Meaning, unless you pursue all people that "abuse" your IP, you are not allowed to pursue any.

Okay, so no HD on the Revolution, that's no big deal and is part of why I think the Revolution might have a decent shot. They will be cheaper and most people don't own a HD TV as of yet, plus the hD capability could always be a future add-on, so lets leave Revolution out of this argument. lol

I know that it is for trade mark. For example, if a company doesn't persue legal action against peopel using their trade mark or brand name, than it become a generic name and they can't do nothing against it. Accodring to US law they must take care of their IP, or they loose the claim for it.
This is the reason so many companies have law suites that sound stupid to you about people using names similliar to their own and such... they have to according to US tradmark/copyright laws.
I am not so sure how exactly everything applies, and how it apply here though.

Oblivion's supposed to be out at release or shortly thereafter, so you'd actually be getting a 360 before a Revolution.

This is assuredly not true. I think what you have heard is that if you do not go after people abusing your IP it becomes more difficult to protect, which is true. IOW, with the all or nothing approach you describe, nobody could ever protect their IP because there can always be someone you don't know about abusing it, and if that makes it legit for others to take your IP, then it's hard to imagine a scenario where you could possibly win a case to protect your IP. In the end it's wise to at least send a cease and desist letter to anyone you see illegitimately using your IP as soon as you see it, and while it makes your IP more protected, it’s not invariably necessary.

Any corporate lawyers out there who want to weigh in on this one? I know how you probably loathe giving away free legal advice, but throw us a bone.
I can see Sony's viewpoint on this. It would make it harder to know how much market penetration you have in a given area. But on the other hand, this just doesn't make much sense. A company is generally happy if it moves product...even if you use it in Antarctica. I don't know how much stock I put in this one the more I look at it.
I'd really like another established news source to report something on this situation.

I think they want to stop this kind of thing because it reduces the impact of the release when it finally is released for that region, as well as producing a relatively bad experience for anyone who buys the system. IOW, if they were never planning to release in a particular region, then they likely wouldn't care much, but when they're going to make the money either way, they certainly rather take the road that leads to more repeat business (IOW, the one that produces a more positive player experience).

Not true. When I got my MCSE certs. I has sent a doc that had the font size, colors I could use, size of the logo, etc. Logo's are more than reg trademarks, they *ARE* the company so to say. hell look at MS. The sue the pants of anyone trying to use the Windows or sim name. Lindows? Hello :mad:
