GameSpot reports (http://www1.gamespot.com/news/2005/07/27/news_6129836.html)
GTA publisher Take-Two has had a class action lawsuit filed against it by 'Florence Cohen, [who] claims she was "damaged" after learning of the sex minigames hidden in San Andreas, as she had bought what she thought was an M-for-Mature-rated game for her grandson'. The lawsuit charges Take-Two and Rockstar with "unfair business practices, consumer deception and false advertising," according to the AP.
What the hell did Take2 do? At least sue the right people!

Um....did you trade it in? Cause if you did, then you should have to buy it again. If you didn't and you still own it, why do you need a second copy?

I find it amusing that its only the interactive sex that is damaging. Watching strippers and watching the character bang prostitutes is ok, but to control it oh no!

This is absolutely insane. I cannot believe some people....
First, she bought her 14 year old grandson a mature rated game that clearly states 17+ on it. Second, she bought him a game called 'Grand Theft Auto' chock full of killing and all sorts of proper villain activity in it. Imagine that, right out of the 'mature' rated box her 14 year old grandson was killin hookers after receiving sex from them, stealing cars, and engaging in plain old fashioned murder! Now shes upset? Over something that is not even playable stock? What this lady doesnt realize is that her 14 year old kid is probably whackin his jimmy to every pornographic movie/photo he can get online. 'Hot coffee' is probably the least damaging for his psyche, especially considering that a 14 year old can get his sticky hands on any form of fetish material he wants...
This lady is an opportunistic, hypocritical, and extremely stupid human being for even trying to sue over this - especially under this pretense.
Draknodred
07-27-2005, 02:04 PM
This is ridiculous... she bought a Mature rated game (17+) for her 14 year old son... So shouldn't she be in trouble in the first place right? For giving him a game that the ESRB ratings said she shouldn't? It's ridiculous, she should of checked the M rating anyway and not given him the game anyway... Adults Only rating is only 1 more year in age... absolutely unbelievable how greedy people are.
SteveRage
07-27-2005, 02:10 PM
So the copius amounts of killing, which the average person will never actually witness, let alone take part in, is just fine and dandy. Yet, show a little sex, which everyone is will more than likely partake of is forbidden? It strikes me as odd that the "lawmakers" (opportunists) seem to have thier eye on seeing that it's OK to depopulate the species, but god forbid you see a tit.
(edit) to everyone surprised at the old lady trying to sue, you all must be forgetting that in America, there is no personal responsibilty for your actions unless someone can sue you for large wads of cash.

It's gotten a surprising amount of news coverage. A few people I know, completely non-gamers, know about the mod, the rating change, the whole fiasco. I think it's been featured on CNN and a bunch of other major news networks.

Now-a-days we feed kids depraved pixelated images of a woman's hoobies and call it entertainment! Rubbish!! In my day, we had morals and standards. It was a simpler time, a time when a kid could entertain himself for days with just some jacks, a yo-yo, or even with the simple joy of picking up prostitutes, driving over pedestrians, then rampaging through a gang of coppers with a chainsaw.

I too, am a little confused why a grandma would buy her 14 y/o Grandson a game in which the word "nigger", "Fuck", "cunt", "motherfucker", "asshole", "spick", "damn mexican", "fucking nigger", "shitbag", "shit", "fucktard", etc... are used. Oh and then she's SHOCKED that it contains sex? In light of the words I just listed, the SEX part is a minor side-effect, isn't it? Think about it for a minute...
Gee, I wonder what her grandson's going to get more long-lasting bad effects from? Seeing two people doing something found in nature or becoming a racist, cursing man (just like the rest of us).
The problem is that she bought a game made for people who are already accustomed to this behavior ... for a fourteen year old CHILD!! She should be ripped a new one by the judge (and her damn lawyer should have his testicles sawed off with a rusty saw, just because I hate lawyers like that).

Eh, be funny when she wins. It isn't that farfetched to think she will, although I expect damages to be non-existant.
Simple fact of the matter is they slid content past the ESRB that should've yielded a different rating. They either did it purposely(real bad), or negligently(still bad enough to get sued).
Welcome to America, land of the lawyers, home of the litigated.
Stooby
07-27-2005, 05:48 PM
Had the content actually been shown to the ESRB it would not have warranted a higher rating. The people are fully clothed for fucks sake. It just got a higher rating because the ESRB was pissed that Rockstar slid something past them. Which was, probably, not intentional. They just either forgot they had it in the game, or didn't think it was a big deal since it was only unlockable by breaking the EULA.

I'm going to go with the fact that, technically, an 18 is allowed to sign up and die for our country and a 17 year old isn't. Has to do with what people collectively think is the age where one reaches maturity/adulthood and can thus dress themselves.

Read about this here (http://news.teamxbox.com/xbox/8839/Grandma-Sues-Rockstar-Over-San-Andreas/) as well. It boggles the mind though, how she thinks that she needs $5m. I get duped into buying something i didnt want, the max i want back is probably the price of whatever i bought. This is overkill to the extreme, not to mention how bullshit the whole ordeal is. This will get hilariously thrown out. Maybe Take 2 will have a 10 year old child as their defence lawyer? I'm sure he might be able to point out how dumb Mrs Choen is.Laurence D. Paskowitz, the lawyer who filed the lawsuit on behalf of Cohen, said no parent would knowingly buy an AO (adult-only) game for their children.
No, but it seems every parent, grandparent, friend of the family and well-meaning associate buys kids M (mature) rated games for the children.

Come for our trees, stay for our rocks.
Thankfully you can't file frivolous lawsuits up here. You CAN file suits against really wierd things if you can somehow involve the charter of rights & freedoms (ie. you are being discriminated at work because they're firing you for drinking even though you're an alcoholic and alcoholism is a disease and you can't fire someone for having a disease, can you?).
You can't sue McDonalds for making you fat or Tim Hortons for giving you hot coffee that you decide to stick between your legs and spill on your crotch.

Granny bought an M rated game for her granson of 15 years of age.
Then she finds out about the "hot coffee" mod.
Then sue's take two.
If I'm not mistaken the mod is only availble over the net. that means that the little granson, If infact he does have the mod, went online, the place where one can find any and all forms of porn and out bad stuff eg: bomb makeing plans, ect... , downloaded and install the mod. Then loaded up the game to take CJ (your in game persona) to his girlfriends house for a date. after finishing the date and getting ask back for some "hot coffee". She(granmamma) happend to be in the room at the time of the coffee offering.
did I missing anything?

Whilst mothers and opportunist lawyers around the world are unified in their outrage, i wonder how re-invigorated GTA's sales are, bearing in mind the game HAS been out for nearly a year now. I would have thought most who were going to buy the game have already done so, i wonder how many more have picked it up due to this press attention or merely to see what all the fuss is about.
The problem is that here in America we have inundated the populace with a suing culture. People are looking for their chance to sue someone and get freakin rich on someone else’s dollar. They think it is ok because they take money from faceless businesses and even malpractice suits are running rampant. It used to be that everyone thought doctors were rich or at least well off and some are being run out of business now because some retard went to the doctor, didn’t follow the instructions given to him, and got even worse. Insurance for doctors and other businesses is higher than ever because someone can now get a 3 million dollar settlement from sticking their dick in a pencil sharpener even when it is obvious to the ENTIRE world that that man’s penis should not have been there.
