Since this is obviously one of the most pressing issues currently facing the United States today, Hilary Clinton has been urging the FTC to investigate the "Hot Coffee" incident. Actually, there has not yet been an official announcement that the FTC is investigating. That can only come from the SEC or after an investigation concludes that shows that there was wrongdoings.

I interviewed the FTC (http://www.kotaku.com/gaming/breaking-news/ftc-talks-about-gta-114297.php) this morning about this.

Uhm, it's a regulatory agency over seeing if a voluntary ratings service was defrauded?

What Federal law was violated? What would the punishment be? Oh yeah a fine.

For fucks sake Take Two already agreed to remove the product and replace. The ESRB already did it's job and changed the rating based on the hidden content.

Also I just saw NIPPLES on my SIMS 2 game. Who can I sue????

In a related story, the lawyer that started the ball rolling today announced he has found a way to unlock p0rn images on Desktop computers as well.
"The user need only press Start then Run and enter the cheat code to see graphic porn images unlocked by windows for display.", said an outraged Thompson. I mean, I agree with the new rating, it's what makes the ESRB work...but the investigation they are going through is crazy. Now they're accusing Rockstar of purposely putting in the content and hiding it with the sole intention of spiting the ratings board? Please, that's like accusing video game makers of making games just to spite the board game industry (which is pretty much dead). And trust me, no one's going to want to "trade in" their game for the M-rated one.

I agree wholeheartedly. Changing the rating isn't really a huge issue, though it does mean that I'm kicking myself for not picking up the Xbox version sooner and also for trading in my PS2 copy months ago.

It's the hysteria that this has brought on that is so mindboggling. Again I wonder, if this was another game that didn't already have the profile that GTA has (ie. God of War for one example of nudity in a game and some off-camera sex games), would there be the hue and cry over some locked and unused content?

Doesn't anyone remember Sim Copter and the lovely little easter egg in there? I don't recall congress stepping in over that. I think that if this kind of material had been present in a game like, oh, Barbie's Paint Palace, THEN you could holler and yell about the evil game industry corrupting kids.

Having it in an already M-rated game that shouldn't be sold or rented to kids anyway is pretty moot. But since when has logic and common sense had any bearing on public discourse when you can say that the bugaboo of the day is responsible for destroying society?
