If you run a contest, you are actually legally liable to produce the award you specified ahead of time.

Imagine if a company like Microsoft could run a "$1 billion for the next person who visits www.live.com!" and then when they don't pay out, they could say "hey, it was free to visit www.live.com, we don't owe anyone anything." and still get the benefit of millions of hits.

If they were to do that, they'd probably just say that Bill Gates won.
